1. Acceptance
By creating a Collabify account you agree to these Terms. If you are acting on behalf of a company, you represent that you have authority to bind that company.
2. The Collabify platform
Collabify is a two-sided marketplace connecting brands ("Buyers") with content creators ("Sellers"). Collabify is not a party to any content deal — we provide the platform and the escrow mechanism.
3. Escrow and payments
When a Buyer funds an order, Collabify holds those funds in a segregated trust account. Funds are released to the Seller only when the Buyer approves delivered content, or in accordance with Collabify's dispute resolution process.
4. Platform fee
Collabify charges a 15% commission on the package price, deducted from the Seller's payout. The Buyer pays the listed package price in full. This fee structure will not change for existing orders if Collabify updates pricing in the future.
5. Content ownership
Upon Buyer approval and full payment, the Seller grants the Buyer a perpetual, royalty-free, worldwide licence to use the delivered content across all paid and organic media, unless a more restricted licence was explicitly agreed in the brief.
6. Prohibited conduct
You may not: circumvent Collabify by executing deals off-platform after initial contact on Collabify; post false metrics or misrepresent your audience; use Collabify to distribute illegal, harmful, or deceptive content; or attempt to reverse-engineer the platform.
7. Disputes
In the event of a dispute between Buyer and Seller, either party may raise a dispute from the order page. Collabify will review available evidence and make a binding determination within 5 business days. Collabify's determination is final.
8. Termination
Collabify may suspend or terminate accounts that violate these Terms, at its sole discretion, with or without notice. Active escrow funds will be held and disbursed in accordance with the relevant order's status at the time of termination.
9. Limitation of liability
To the maximum extent permitted by Pakistani law, Collabify's total liability for any claim arising from use of the platform is limited to the fees paid to Collabify in the three months preceding the claim.
10. Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan. Disputes will be resolved in the courts of Lahore, Punjab.
